Overtime and Wage & Hour

Have You Been Paid What You’re Owed? Overtime and Wage & Hour Disputes

New York and New Jersey Overtime and Minimum Wage Laws

State and federal wage and hour laws, including the Fair Labor Standards Act, provide employees with many important rights relating to employee compensation. Two of the most important rights are the right to receive overtime pay and the right to receive at least minimum wage.

Overtime Pay

Many employees are entitled to receive time-and-a-half pay when they work more than 40 hours in a week. The right to receive overtime pay primarily depends on your job functions and duties, and the type of business for which you work. However, your right to receive overtime pay does not necessarily depend on whether you are paid by the hour or you receive a set salary. In other words, both hourly and salaried employees can be entitled to receive overtime pay.

If you believe your employer has violated your rights by failing to pay you for overtime, then you should consider contacting Resnick Nirenberg & Cash for a consultation with an employment law expert. We are experienced in handling both individual overtime cases and class or collective action overtime lawsuits.

Minimum Wage

While there are many exceptions for certain jobs, federal and state laws require employers to pay most employees a set minimum wage. Although federal law only requires employers to pay a minimum of $5.85 per hour, both New York and New Jersey have set the minimum wage at $7.15 per hour. If you work in either New York or New Jersey and believe you have been paid less than minimum wage, you may have a legal claim.
