Clifton, New Jersey Retaliation Lawyers

Retaliation occurs when an employer takes an adverse employment action against an employee, such as firing, demoting or harassing them, because they engaged in an activity that the law protects against retaliation.

At Rabner Baumgart Ben-Asher & Nirenberg, P.C., our New Jersey whistleblower lawyers represent employees who have experienced retaliation in the workplace in New Jersey and New York. For example, we handle cases in which employees have been wrongfully terminated because they complained about illegal discrimination, such as discrimination based on age, race, disability or gender at their jobs.

We also handle whistleblower claims under New Jersey’s Conscientious Employee Protection Act ("CEPA"). Among other things, CEPA prohibits companies from retaliating against employees who object to or refuse to participate in activities they reasonably believe are illegal, fraudulent, criminal, or violates a clear mandate of public policy relating to public health, welfare or the environment.

Likewise, we handle retaliation cases under the Family & Medical Leave Act ("FMLA"), the Fair Labor Standards Act ("FLSA") and many other state and federal employment laws that protect whistleblowers. We also represent employees of state and local municipal governments who have been retaliated against because they exercised their First Amendment rights such as the right to Freedom of Speech and Freedom of Religion.

Experienced New Jersey Whistleblower Attorneys

In fact, retaliation claims are among the most common type of claims handled by our employment law attorneys. We have settled countless retaliation claims through negotiations, and litigated them in both state and federal court. For instance, one of our precedent-setting cases, Brennan v. Norton, makes it clear that the notice requirement of New Jersey’s Tort Claims Act does not apply to claims brought under CEPA.
