Race & National Origin Discrimination

Have You been Treated Unfairly Because of Your Race or National Origin?

Fighting Workplace Racial Discrimination in New York and New Jersey

America is perhaps the world's most racially diverse nation. While this diversity is certainly a point of pride, it can also lead to racial tension or prejudice in the workplace. Since this prejudice can directly harm your career and negatively impact on your job opportunities, Title VII the Civil Rights Act of 1964, the New Jersey Law Against Discrimination, and the New York Human Rights Law have made race and national origin discrimination in the workplace illegal.

If you have experienced discrimination based on your race or national origin at work, your rights may have been violated. How do I know for sure if I am the Victim of Discrimination?

It is often difficult to know if you have been the victim of race or national origin discrimination. Generally, though, you can ask yourself two questions:

  • Were you fired, denied a job, passed over for a promotion, harassed, or given lower pay or benefits, or otherwise treated worse than other workers?
  • Do you think your race is the reason why you suffered those consequences?

If you can honestly answer yes to both of those questions, then you should have an employment lawyer experienced in race and national origin discrimination law evaluate your case. Even if you have not been fired, denied a job, passed over for a promotion, harassed or received less compensation or benefits than other workers, you may still have been the victim of a "constructive discharge," where the employer makes working conditions so intolerable that you must quit. See our employer retaliation page for more information about constructive discharges.

Not all racial discrimination is caused by conscious bigotry.

In fact, it is relatively rare in this day and age to encounter an employer who overtly and consciously mistreats an employee based on his or her race. More often, employers simply express an unconscious preference for people who are more like themselves. Correspondingly, employers may exhibit an unconscious distaste for people who are different. Fortunately for victims, it is illegal regardless of the intent (or lack of intent) behind the discrimination.
