Rights of Employees
Parsippany - Troy Hills Lawyers Protecting Privacy at Work
Privacy at work is an extremely important employment law right. It includes the right to privacy when using company equipment such as computers, laptops, iPads and cell phones. It also includes the right to privacy in your office or at your workstation, as well as the right to privacy with respect to your medical records and other personal information. Likewise, it includes issues regarding random drug testing.
Like many aspects of employment law, the right to privacy in the workplace is not always black and white. Rather, it often requires a careful balancing of the employee’s right to privacy against the employer’s right to ensure employee safety and to promote efficiency. For example, companies have the right to monitor certain employee communications at work, but might need to warn employees about the forms of monitoring it is using. Similarly, random drug testing may be permissible for employees whose jobs require them to drive or use heavy machinery, but is much more restricted for employees whose jobs do not involve similar safety risks.
