Montclair Wrongful Termination Law Claims

In New Jersey, wrongful termination (also known as wrongful discharge) is a general term for when you are fired for an illegal reason. It includes many different things.

For example, it includes being fired due to unlawful discrimination, such as because of your age, gender, race or disability.  It also includes being fired for exercising your rights under laws such as the Family & Medical Leave Act ("FMLA"), the New Jersey Family Leave Act ("FLA"), or the Fair Labor Standards Act ("FLSA").

It also includes being fired because you objected to something you reasonably believed was illegal or being fired in violation of a clear mandate of public policy, in violation of New Jersey's whistleblower law, the Conscientious Employee Protection Act ("CEPA"). Likewise, it can include being fired in violation of an employment contract, such as a breach of a one year contract or an agreement that says you can be fired only for “just cause.”

While there are many forms of unlawful wrongful termination, not every unfair firing is legally actionable. As a result, it is important that you speak to an employment law expert who understands your rights and can properly evaluate your potential legal claims.
